Terms of Service

1. Introduction

Welcome to Servzio (“Service”), a SaaS invoicing and business management platform operated by Wonder 4 Marketing Inc. (“Company,” “we,” “us,” or “our”). By accessing or using servzio.com or any related services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service.

2. Account Registration

To use Servzio, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must be at least 18 years old to create an account. You agree to notify us immediately of any unauthorized use of your account.

3. Subscription Plans and Billing

Servzio offers a free 7-day trial and paid subscription plans (Professional and Business). Paid plans are billed on a monthly or annual basis according to the plan you select. All prices are listed in US Dollars (USD).

• Free Trial: New accounts receive a 7-day free trial with access to Professional-tier features. No credit card is required to start the trial.
• Professional Plan: $29.99/month or $329.99/year.
• Business Plan: $59.99/month or $649.99/year.
• Subscription fees are charged in advance at the beginning of each billing cycle. You authorize us to charge your selected payment method for recurring fees.

4. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period.

• 30-Day Money-Back Guarantee: If you are not satisfied with Servzio, you may request a full refund within 30 days of your initial paid subscription purchase. Refund requests should be sent to support@servzio.com.
• Refunds are not available for renewals beyond the first 30 days or for annual plans after 30 days from the purchase date.

5. Acceptable Use

You agree to use Servzio only for lawful purposes. You may not:

• Use the Service to transmit any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or any systems or networks connected to the Service.
• Use the Service to send unsolicited communications (spam) or for any fraudulent purpose.
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
• Upload or transmit viruses, malware, or any other harmful code.
• Use the Service in any way that could damage, disable, overburden, or impair our servers or networks.

6. Data Privacy

Your use of Servzio is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

7. Your Data

You retain all rights to the data you upload, create, or process through Servzio (“Your Data”). We do not claim ownership of Your Data. You grant us a limited license to host, store, and process Your Data solely for the purpose of providing the Service to you.

You are solely responsible for the accuracy, legality, and appropriateness of Your Data. You may export or delete Your Data at any time through the Service.

8. Intellectual Property

The Service, including its original content, features, functionality, design, and branding (excluding Your Data), is and will remain the exclusive property of Wonder 4 Marketing Inc. and its licensors. The Servzio name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Wonder 4 Marketing Inc. You may not use them without our prior written permission.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Wonder 4 Marketing Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or in connection with your use of the Service.

In no event shall our total aggregate liability exceed the amount you paid to us for the Service during the twelve (12) months preceding the event giving rise to the liability.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

11. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in activity that is harmful to other users or the Service. Upon termination, your right to use the Service will cease immediately. We will make reasonable efforts to allow you to export Your Data before deletion.

12. Modifications to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

13. SMS/Text Messaging Consent

By providing your phone number and opting in to receive SMS messages from Servzio, you consent to receive text messages related to the Service, including but not limited to appointment reminders, invoice alerts, payment notifications, and service updates.

• Frequency: Message frequency varies based on your account activity. You may receive up to approximately 10 messages per month.
• Opt-Out: You may opt out at any time by replying STOP to any SMS message received from Servzio. You will receive a one-time confirmation message and will no longer receive SMS messages.
• Help: Reply HELP to any message for assistance, or email support@servzio.com.
• Rates: Message and data rates may apply. Servzio is not responsible for any charges imposed by your mobile carrier.
• Carriers: Carriers are not liable for delayed or undelivered messages.
• Consent Not Required for Purchase: Consent to receive SMS messages is not a condition of purchasing or using Servzio.

14. Voice Calls & Telephony Consent

By using Servzio's voice calling features, you consent to the following:

• Call Recording: Calls made or received through Servzio may be recorded for quality assurance, training, and record-keeping purposes. By placing or accepting a call through the platform, all parties consent to recording in compliance with applicable state and federal laws.
• Caller ID: Your business phone number registered with Servzio will be displayed as the caller ID when making outbound calls.
• TCPA Compliance:You agree to comply with the Telephone Consumer Protection Act (TCPA) and all applicable telemarketing regulations when using Servzio's calling features. You must have prior express consent before making marketing calls.
• Third-Party Providers: Voice services are provided through third-party telephony providers (Twilio). Your use is subject to their acceptable use policies.

15. Communications Compliance (A2P & 10DLC)

When using Servzio to send SMS, email campaigns, or automated communications to your clients, you agree to:

• Obtain Consent: You must obtain proper written or electronic consent from your clients before sending them any marketing communications via SMS, email, or voice.
• Honor Opt-Outs: You must promptly honor all opt-out/unsubscribe requests. Servzio automatically processes STOP replies for SMS.
• Content Restrictions: You shall not use Servzio to send prohibited content including but not limited to: SHAFT content (sex, hate, alcohol, firearms, tobacco), illegal content, phishing, or deceptive messaging.
• 10DLC Registration: For US-based SMS, Servzio registers campaigns under 10DLC (10-digit long code) regulations. Your business information may be submitted to The Campaign Registry (TCR) for verification.
• CAN-SPAM & TCPA: All email and SMS communications must comply with the CAN-SPAM Act and TCPA. You are solely responsible for ensuring your communications meet these requirements.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the State of Florida.
